Sex Crimes Archives

Consider carefully before filing domestic violence charges

Domestic abuse is a terrifying thing, and one of the most frightening and serious criminal acts under the law. It is a special kind of torture in which victims face emotional, psychological and sometimes physical trauma on a daily basis, and there is often nowhere for them to seek refuge. Because of the severity of domestic violence, the state takes such accusations very seriously. That is why you should not bring charges without good reason.

What are Florida's sexual battery laws?

In many states, most sex crimes are given their own classification, treated as separate crimes. This is not the case with Florida law, where many different sex-related crimes all fall under the umbrella of sexual battery. Previously independent crimes such as rape and sodomy are examples of the types of offenses that fall under sexual battery laws. As a result of this, the statutes, defenses and requirements are the same for many sex crimes in Florida.

Helping Florida victims file protective orders

Often when we talk about sexual crimes and domestic violence, we talk about the importance of defending yourself against false allegations and building a case for your criminal defense. However, it is important to remember that many claims of domestic violence and sexual assault are very real. Unfortunately, sex crimes are problems for a great many Florida residents, and victims of such crimes deserve to feel safe and secure in the knowledge that the legal system will work to protect them.

When most people think of sex crimes, they imagine a situation where someone sexually assaults another person by forcefully penetrating them against their will or coercing them into consenting to something they do not want to do. While these are certainly common types of sex crimes, there are other types of sex crimes as well, such as crimes committed against minors. When you bring minors into the equation, things can get much more complicated, even if you are not even dealing with issues of penetration.

Rape laws in Florida

Unlike some states, Florida law does not recognize rape as its own criminal offense. Instead, rape is included as an additional type of sexual battery offense. As such, the prosecution must prove that sexual battery occurred, or that elements of a sexual battery existed, in order to prove an accusation of rape.

Domestic violence allegations are among the most frightening, disheartening and in some cases embarrassing allegations that an individual can face. Even if no actual violence occurred, being arrested and charged with a domestic violence crime can cause you to be removed from your house and taken away in handcuffs, sometimes in front of your children and neighbors. This can have a profound negative impact on your reputation, even if you are eventually acquitted or the charges are dropped.

How common are false rape reports?

There are some cases of sexual assault that are cut-and-dry: the accused fingerprints and fluids are found on the victim's clothes or person, or the accused has a concrete alibi for where they were when the assault allegedly occurred. But for one reason or another, sex crimes are not always that simple. In many cases, a thorough investigation must be launched into the details of the sex crime in order to determine what happened.

Marriage does not mean a right to sex

Sex crimes are very serious legal matters that can come with steep legal penalties if a person is convicted. There are many different types of sex crimes, but the most well-known and arguably the most common are sexual assault and rape. Many people know rape as forcing sexual contact onto another person who does not desire the contact, and while this is accurate, not everyone realizes that rape can occur in a marriage as well.

If a victim doesn't say no, can it still be called rape?

For the most part, rape is a pretty cut-and-try criminal offense. If any form of sexual intercourse is attempted or performed by one part on another party without one party's consent, regardless of the genders of the aggressor and the victim, then it is considered rape. In most states, it does not matter if the parties are married or if force is exercised; nonconsensual sexual intercourse is considered rape.

How can I help with domestic violence issues?

Domestic violence is a serious threat to countless American citizens, including Florida residents. Many people think that domestic violence is only a women's issue, and while it may be true that women are the majority of domestic violence victims, there are certainly men who are victims too. Some children face domestic abuse as well, regardless of their gender, and domestic abuse can cause serious trauma to a child's development. This is why it is so important to do whatever possible to stop domestic violence.
