What are Florida’s laws regarding heroin?

| Sep 11, 2015 | Drug Charges |

There are an unbelievable amount of drugs circulating throughout the state of Florida, ranging from legal, prescription drugs to illegal drugs used for recreation or to satisfy an addiction. Many of these drugs are unknown to most people because it would be extremely difficult to keep up with all of the different names for all of the different drugs. However, there are some drugs that are notorious enough to be household names all across the country, let alone in Florida. One such drug is cocaine, and another is heroin.

These drugs, in particular, are well-known amongst many different people because of the incredible health risks they pose to consumers and bystanders alike, as well as the incredible powers of addiction that they have. First-time cocaine and heroin users run the risk of suffering serious addiction and withdrawals. First-time users also run the risk of serious legal consequences if they are convicted of crimes related to these drugs.

Simple possession of heroin is considered a 3rd degree felony in Florida, but possessing 4 grams or more is considered trafficking no matter what, which will be treated as a 1st degree felony. The sale of heroin is a 2nd degree felony, but again, selling 10 grams or more will be treated as a 1st degree felony.

As you can see, the punishments are not exactly concrete and depending on a variety of factors, punishment may be more severe or less severe. Generally speaking, larger amounts of heroin result in more serious consequences, with trafficking over 30 kilograms often landing those convicted with life in prison. For this reason, if you are accused of a heroin-related crime in Florida, it is imperative that you speak with an attorney as soon as you can in order to begin building your defense.
